The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act'), inter alia, praying that an arbitrator be appointed to adjudicate the disputes that have arisen between the parties in relation to the purchase orders. 2.

The learned counsel for the parties state that the parties are agreeable if an arbitrator is appointed to adjudicate the disputes. The parties further request that Mr Justice V.K. Gupta (Retired), former Chief Justice of Jharkhand be appointed as the arbitrator.

Accordingly, Mr Justice V.K. Gupta (Retired) Former Chief Justice of Jharkhand (Mobile No. 9650333000) is appointed as an Arbitrator to adjudicate the disputes between the parties. This is subject to the Arbitrator ARB.P. 812/2016

making the necessary disclosure under Section 12 of the Act and not being ineligible under Section 12(5) of the Act.

The representatives of the parties shall appear before the Co-ordinator, Delhi International Arbitration Centre (DIAC) on 21.03.2017 at 11:00 AM. The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules.

The petition is disposed of.
