O R D E R

% 09.08.2017 The Court has heard learned counsel for the parties, including the respondents and the learned counsel for the Court Observer. The allegations made by the appellant read together with the Court Observer's status report dated 25.07.2017 are serious and require careful examination. The Court has already considered the status report of the Court Observer which contains a very unsatisfactory picture. No further observations would be made given the fact that the learned Single Judge has fixed the matter for hearing on 25.08.2017.

This Court is of the opinion that the learned Single Judge should consider the applications made by the appellant on their merit and pass order at his earliest convenience having regard to the nature and seriousness of the

matter. Till the next date of hearing or till such time the learned Single Judge proceeds to indicate any modifications, the Court hereby directs that no expenditure other than routine expenditure for the running of the business shall be undertaken by any cheque which is not signed by Sh. Pawan Tyagi, one of the co-signatories appointed by the Court. The Court Observer is also enjoined not to make any investment - directly or indirectly - through Jitender Malik/broker/third party, from the funds of either the company or Mon Mohan Kohli. All rights and contentions of the parties with respect to the merits of the pending suit and its applications are reserved. The appeal is disposed of in the above terms.
