% 06.01.2017 After some hearing, learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to approach the Court in case the date for election is fixed and the petitioner is not permitted to submit his nomination form notwithstanding the fact that he has filed a revision petition against the debarment order passed by the Returning Officer before the Financial Commissioner.

In view of the statement made, the writ petition is dismissed as withdrawn. We clarify that it will be open to the petitioner to move an

appropriate application before the Financial Commissioner or before this Court in case the date of filing of nominations is announced and the revision petition preferred by the petitioner has not been disposed of. SANJIV KHANNA, J.
