By way of this petition filed under Section 226 of the Constitution of India read with Section 482 Cr.P.C., petitioner seeks release of the land of the petitioner family which has been seized vide letter No. 173 ACP/DIV/C with the following prayers:

i) It is therefore most humbly prayed that this Hon'ble Court may be pleased to issue a writ of direction to the respondent to drop the letter No. 173(ACP)DIU/C and order for release of the property of the petitioners family mentioned in the aforesaid letter.

ii) That the investigation of case FIR No. 110/2014 may kindly be transferred to some other agency except Central District, Delhi. 2.

Mr.Pawan Sharma, Advocate on behalf of the petitioner submits that as the investigation has been transferred the prayer No. (ii) stands satisfied.

In respect of prayer No. (i) in view of the reply filed by the respondent he seeks leave to withdraw the writ petition with liberty to challenge the Annexure P-1.

In view of the above, the writ petition is dismissed as withdrawn granting the liberty as prayed for.
