% 09.10.2018 Notice. Learned APP accepts notice on behalf of respondent no.1. Mr. Rajiv Gupta, Manager/ Authorised representative (AR) of respondent no.2 Bank is present in Court and accepts notice. Mr. Rajiv Gupta submits that matter has been settled between the petitioner and respondent no.2 without any undue force, pressure or coercion, inasmuch as, entire settled amount has already been paid by the petitioner to respondent no.2. He further says that in view of the settlement, respondent no.2 has no objection in case FIR No.34/2018 under sections 420/406/34 IPC registered at police station Amar Colony and the consequent proceedings emanating therefrom are quashed.
Keeping in mind the settlement arrived at between the
petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
