O R D E R

% 06.01.2017 On 4th January, 2017, learned counsel for petitioner had submitted that surgery of petitioner's wife was scheduled for 10th January, 2017. Learned Additional Public Prosecutor sought time to verify this fact. It is submitted that, on verification, it has been found that petitioner's wife has to undergo a small surgical procedure on 12th January, 2017. Petitioner has sought interim bail in order to be with his wife during the surgery and also to look after her post surgery.

As per the learned Additional Public Prosecutor, petitioner's presence is not required as surgery will hardly take 20 minutes and thereafter petitioner's wife will be discharged on the same day. Learned counsel for petitioner submits that petitioner has also to arrange the funds besides taking care of her wife.

Keeping in mind that petitioner's wife has to be operated on 12th January, 2017, in my view, his presence would be required to take care of her. Accordingly, interim bail for two weeks is granted to petitioner, subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety of the like amount to the satisfaction of trial court.
