% 15.02.2018 Appellant No. 1, 3, 5 and 8 are present in person. Appellant No. 1, appellant No. 3, appellant No. 5 and appellant No. 8 also represent and appear for their spouses, appellant No. 2, appellant No. 4 and appellant No. 9 respectively. Similarly, appellant No. 5 represents her daughter appellant No. 6.
2. They state that they would like to draw the present appeal. Appellant
No. 8 further states that he has spoken to appellant No. 7 in this regard and he has also agreed to withdraw the appeal.
3. Appellants states that they will raise all the issues and contentions regarding the proposed scheme before the Learned Company Judge. They seek indulgence for an early and fast disposal of the company petition. 4.
A number of creditors of the company M/s A.N. Buildwell Private Limited are present in the Court. It is stated that about 1791 persons are affected by the present litigation. They have prayed that the company petition should be fast tracked in view of economic and financial hardships faced by more than 1000 families. Issues and questions should be resolved and settled at the earliest.

We appreciate the statement made by the appellants, who want to withdraw the present appeal.

It will be open to the parties to press for early and quick disposal of the company petition. We hope and trust that the spirit shown by the appellants and the respondents will be equally reflected during the course of the proceedings before the Company Court for it appears that there are different perspectives and perceptions on some aspects. 6.
The appeal is accordingly dismissed as withdrawn, without any order as to costs. We clarify that we have not expressed any opinion on any matter and issue pending before the Company Court. SANJIV KHANNA, J.
