Learned APP accepts notice on behalf of respondent no.1. Respondent no.2 Rajesh Kumar is present in Court along with his counsel and accepts notice. He has been identified by SI Govind Singh of police station Uttam Nagar.

A dispute regarding property between the petitioners and respondent no.2 led to registration of FIR No.246/2010 under section 452/380/506/34 IPC at police station Uttam Nagar on the complaint of respondent no.2. Offences punishable under sections 323/411 IPC were added subsequently. Respondent no.2 submits that he has settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion vide Compromise Deed dated 11th September, 2018 and has no objection if aforesaid FIR is quashed against the petitioners. Affidavit of

respondent no.2 to this effect is on record at page 15. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.
