This Revision Petition under Section 115 of the Code of Civil Procedure, 1908 (CPC) impugns the order [dated 31st March, 2017 in Suit No.105262/2015 of the Court of Additional Senior Civil Judge (North-East), Karkardooma Courts, Delhi] of dismissal of the application filed by the petitioner/defendant No.1 under Order VII Rule 11 of the CPC. 2.

The counsel for the petitioner / defendant no.1 has handed over in the Court a copy of the order dated 17th October, 2017 in C.M. (M) No.135/2015 preferred by the defendant No.3 in the same Suit, namely, Om Prakash Parihar against dismissal of appeal preferred against the order dated 31st March, 2012 in the Suit allowing the application of the respondent No.1/plaintiff under Order XXXIX Rules 1 and 2 of the CPC. 3.

The counsel for the petitioner / defendant no.1 states that this petition be dismissed in terms of the order dated 17th October, 2017 in C.M. (Main) No.135/2015.

Dismissed as aforesaid.
