% 04.08.2017 The petitioner has preferred the present petition to assail the order dated 05.12.2016 passed by the Central Administrative Tribunal, Principal Bench, New Delhi (CAT/ Tribunal) in O.A. No. 493/2015. The issue raised by the respondent/ applicant before the tribunal was with regard to the treatment of the period of his suspension between 28.01.2009 to 30.11.2011 when the respondent superannuated. The grievance of the respondent was that no decision was communicated to him in relation to the manner in which the said period would be treated.

All that the tribunal has directed is that the petitioner should pass an order communicating to the respondent the manner in which it proposes to

treat the said period of suspension. There can be no possible grievance qua the said order that the petitioner can raise. We find absolutely no merit in this petition. Dismissed. VIPIN SANGHI, J REKHA PALLI, J AUGUST 04, 2017 sr
