O R D E R

% 07.02.2017 This is a petition under Section 15 of the Arbitration and Conciliation Act, 1996, inter alia, praying that an Arbitrator be appointed in place of Justice S. K. Mahajan (Retired) since he had expired. It is seen that Justice S. K. Mahajan was appointed as an Arbitrator by an order dated 10.02.2015 passed by this Court, therefore, in terms of Section 15 of the Act an Arbitrator is required to be appointed. Accordingly, Justice R. C. Jain, (Retired) (Mobile No.9818000380), former Judge of High Court of Delhi is appointed as a Sole Arbitrator to adjudicate the disputes between the parties.

The Arbitrator shall continue from the same stage as left by Late Justice S. K. Mahajan. The parties shall take necessary steps to place the arbitral record before the Arbitrator. The parties are also at liberty to approach the Arbitrator for holding a preliminary hearing.

This order is subject to the Arbitrator making necessary disclosure under Section 12 of the Act and further not being ineligible under Section 12(5) of the Act.

The petition is disposed of.
