% 20.12.2016 Crl. M.A. No.19834/2016 Exemption allowed, subject to all just exceptions. The application stands disposed of.

BAIL APPLN. 2620/2016 The petitioner has sought interim bail for two months in the case FIR No. 765/2015 under Sections 365/ 392/ 394/ 302/ 201/ 413/ 414/ 120B IPC registered at PS - Sarita Vihar. Charge sheet stands filed. However, charges have not been framed. Obviously, the prosecution evidence is yet to be recorded in the case. The ground for seeking interim bail is that the

petitioner's father has to undergo Appendicitis surgery on 25.12.2016. Even if the medical documents placed on record by the petitioner regarding the said surgery were to be accepted as true and correct, the surgery by itself is a minor one. The allegations against the petitioner are rather serious. It is pointed out by Mr. Katyal that the offence in question was committed while the petitioner was on bail in other cases. Attention is also drawn to the order dated 17.11.2016 passed by the Trial Court rejecting the application for interim bail moved by the petitioner which records that the petitioner had even earlier submitted forged medical papers of his father to seek interim bail.

In view of the aforesaid circumstances, I am not inclined to grant any relief to the petitioner at this stage. Dismissed. Dasti.
