O R D E R

The matter was amicably settled in pre-sitting Lok Adalat on 22.01.2018. The terms of the settlement reads as under: - "Appellant M/s. City Life Line Travels Pvt. Ltd. has filed an appeal challenging the recovery right given to the insurance company against the appellant by judgment and award dated 04.11.2016. The respondent insurance company compromised the matter with the claimant Nanhaki Devi and Ors. in the Lok Adalat held on 29.08.2017 and paid an amount of Rs. 14,00,000/- to the claimants.

Negotiations undertaken.

The present appellant M/s. City Life Line Travels Pvt. Ltd. agrees now to pay an amount of Rs. 14,00,000/- to the respondent insurance company. Mr. Dharam Dev who is general attorney of appellant company is present and brought a copy of general power of attorney dated 22.05.2014, board resolution dated 01.05.2014 authorising him to appear and

settle the matter before Pre Sitting Lok Adalat. Appellant has undertaken to file the same.

Both the sides have agreed to settle the dispute for a total sum of Rs. 14,00,000/- (Rupees Fourteen Lacs only), payable by the appellant M/s. City Life Line Travels Pvt. Ltd. to the respondent Insurance company towards full and final settlement of the present claim."

Learned counsel for the parties submit that they are settling the subject matter of the appeal in terms of the settlement arrived in pre sitting Lok Adalat on 22.01.2018.

The appellant shall pay a sum of Rs. 14 lacs to the respondent national insurance company within 30 days, failing which 9% interest shall be payable.

In view of the settlement entered into between the parties, no further orders are required to be passed in this appeal. 5.

Accordingly, the appeal is disposed of.

Copy of the order be given dasti under the signatures of the court Master.
