The present suit has been filed by the Plaintiff-Jagdish Kohli inter alia seeking a decree of specific performance in respect of agreement to sell dated 11th October, 2021 and 12th November, 2013. 3.

In this case, the Plaintiff has admittedly passed away. Ld. Counsel for the Plaintiff has repeatedly made a statement, as recorded by the ld. Joint Registrar on 13th February, 2024, that she is not getting any instructions in the matter.

The Plaintiff has passed away and no steps have been taken to implead the legal heirs. Under such circumstances, the suit is dismissed for non-prosecution.
