O R D E R

% 19.04.2018 The learned counsel for the petitioner has handed over to the counsel for the respondents documents evidencing appointment of the Arbitrator. In view of the same, the Interim Order dated 26.07.2017 shall operate during the pendency of the arbitration proceedings. The respondent shall, however, be at liberty to seek modification/variation/vacation of the Interim Order before the Sole Arbitrator by moving an appropriate application in that regard.

I may only note that the counsel for the respondent submits that this is the first time that he has received intimation about the appointment of the Sole Arbitrator and he shall be moving an appropriate application entering the appearance of the respondent in such proceedings. This of course, is denied by the counsel for the petitioner.

The counsel for the respondent further submits that the respondent is interested in amicably resolving the disputes with the petitioner and prays that the parties may be referred to the Delhi High Court Mediation and Conciliation Centre for exploring the possibility of a settlement. The counsel for the petitioner has no objection to the same. Accordingly, the parties are directed to appear before Delhi High Court Mediation and Conciliation Centre on 23rd April, 2018 at 3:00 p.m.
