O R D E R

% 29.09.2015 The petitioner was initially sentenced to death in a case instituted under Section 302 of the IPC. Later, in appeal, the death sentence was converted to one under life.

The petitioner, for the present, is at Rohini Jail. It has been submitted that the atmosphere in the Rohini Jail has not suited him and he has been suffering from various age related ailments.

The petitioner was released on parole and had to surrender after the expiry of the period of parole on 30.7.2015. One of the prayers in the writ petition is to permit him to surrender directly before the Tihar Jail and not at Rohini Jail. However, such request has become infructuous as before this matter could be taken up, the petitioner had already surrendered before the jail authorities at Rohini.

The additional prayer made in this petition is to direct the jail authorities to transfer the petitioner to Tihar Jail as the environment at Rohini Jail is not suiting him.

It has been submitted that the petitioner has represented before the jail authorities, which representation has not been acted upon till date. The Jail authorities, Rohini, would pass an order on the representation made by the petitioner within a reasonable time. The petition is disposed of.
