O R D E R

% 06.11.2015 Crl.M.A.16408/2015 The petitioner by the aforesaid application seeks modification of the order dated 01.10.2015 passed by this Court in W.P.(Crl.)1425/2015. By the aforesaid order, the petitioner was directed to be released on parole for a period of two weeks from the date of his release on his furnishing a bond in the sum of Rs.10,000/- with two sureties of the like amount to the satisfaction of the Jail Superintendent, subject to the certain conditions.

It has been submitted on behalf of the petitioner that it is difficult for him to arrange for two sureties. The petitioner has a wife who is ready to stand as a surety for him. Thus, the petitioner desires the order to be modified to the extent that only one surety be asked for at the time of release of the petitioner on parole.

Learned counsel for the petitioner, with reference to the nominal roll, has stated that the petitioner has been released on furlough a number of times and on all occasions, he has surrendered before the jail authorities on time.

For the reasons stated in the petition as also considering the circumstances in which the petitioner is not able to arrange for two sureties, the order dated 01.10.2015 is modified to the extent that the petitioner would be required to furnish bond in the sum of Rs.10,000/- with only one surety of the like amount to the satisfaction of the Jail Superintendent. The other conditions imposed on the petitioner by order dated 01.10.2015 shall subsist.

The order dated 01.10.2015 is modified to the extent as indicated above.

The application is allowed and disposed of accordingly. Copy of the order be sent to the Jail Superintendent for intimation and compliance.
