W.P.(C) 6361/2017, CM No. 26354/2017 The present petition has been filed by the petitioner with the following prayers:

"It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleaded to:

(a) issue a writ in the nature of certiorari/mandamus or any other appropriate writ, order to quash the Demand-cum-Allotment letter dated 20.01.2017 and direct the respondents to issue fresh demand cum-allotment letter at the rate of the year 2009 on the same terms and conditions in compliance of order dated 16.12.2009 by adjusting Rs.1 lakh and to maintain the restoration of the Flat No. 95 Sector 19, Pocket-1, third floor, Dwarka, New Delhi in favour of the petitioner; (b) Pass such other and further order as this Hon'ble Court

may deem fit and proper in the facts and circumstances of the case."

Mr. Sanjeev Sabharwal, learned Standing Counsel appearing for the DDA states, subsequent to the filing of the writ petition, the respondent has cancelled allotment letter dated January 20, 2017, on July 26, 2017. Mr. Manoj Kr. Yadav, learned counsel for the petitioner states, the petitioner shall withdraw the writ petition, with liberty to challenge the order dated July 26, 2017 also in a fresh writ petition. With liberty as prayed for, the writ petition and CM 26354/2017 are dismissed as withdrawn. Dasti.
