O R D E R

% 15.02.2019 It is stated that Rs.50,000/- which was still due to be paid to the complainant, has been paid to her through her counsel. Apropos the complainant's apprehension that her minor son and she are under threat both from the petitioner and from her son's father, Mr. Mohit Mathur, the learned Senior Advocate for the petitioner assures the Court upon instructions, that neither the petitioner, who is the brother-in-law of the complainant's estranged husband nor the minor son's natural father could in any way pose a threat to the safety, security and liberty of the minor child. Indeed, they would be extremely concerned about the child's safety and would extend all cooperation in this regard.

The petitioner has joined investigations and undertakes to do so on every occasion when he is so called by the police.

In view of the above, it is directed that in the event of his arrest in this case, the petitioner shall be released on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like amount to the satisfaction of the Investigating Officer and subject to the following conditions:- (i) the petitioner will regularly appear on each and every date of hearing to be fixed by the Court concerned;

(ii) the petitioner will not try to influence, contact or meet the complainant and prosecution witnesses in any manner; (iii) the petitioner will not leave the country without prior permission of the Court and the passport, if any, shall be deposited with the Trial Court concerned; and (iv) in case of change of his new address or contact number, the petitioner will promptly intimate to the SHO/IO of the case and intimate the Trial Court also;

Further, at this stage, at joint request of the parties, the case is referred to the Delhi High Court Mediation and Conciliation Centre where the parties shall appear on 19.02.2019 at 3 pm. The brother-in-law of the petitioner i.e. Mr. Anmol shall also be present before the Mediation Centre. The IO shall intimate him about the same.
