2. The prayer in this writ petition is for a mandamus to the Respondent to comply with the order dated 3rd July, 2017 passed by the Commissioner of Customs (Appeal).

3. Learned counsel for the Respondent appearing on advance notice, informs the Court that the Department is aggrieved by the said order and has already filed an appeal to the Customs, Excise and Service Tax Appellate Tribunal (CESTAT).

He further states that since the Petitioner is seeking enforcement of the order of the Commissioner of Customs (Appeal), the

Department will move an application forthwith before the CESTAT for the early hearing of its appeal.

4. In view of the above, no orders are called for in this writ petition and same is dismissed accordingly.
