O R D E R

% 08.05.2017 I.A. No.5671/2017 The present application has been moved jointly on behalf of the parties under the provisions of Order XXIII Rule 1 CPC seeking disposal of the suit in terms of the compromise arrived at between the parties as elaborated in paragraph 2 of the application. The application has been duly signed by the parties as well as their respective counsel and is supported by affidavits of Col. J.K. Sharma (Retd.) on behalf of the plaintiff and Mr. Jijith K., defendant No.1.

The settlement entered into between the parties is lawful and the same is taken on record. The parties shall comply with their reciprocal obligations there under, without demur. In view of the foregoing, the application is allowed and disposed of accordingly.

CS(COMM) 1625/2016 & I.A. Nos.15592-15593/2016 In view of the settlement arrived at between the parties as aforesaid, the suit is decreed in accordance with the aforesaid application

being I.A. No.5671/2017 and paragraph 63 (i) to (iii) of the plaint. Decree sheet be drawn accordingly.

Pending applications, if any, also stand disposed of. The date already fixed in the matter before the Joint Registrar, i.e., 14.07.2017 stands cancelled. In view of the circumstance that the suit has been settled out of court, before any evidence has been recorded on the merits of the plaintiffs' claim, the Registry is directed to refund half amount of the court fees paid qua the claim of the plaintiffs in the present suit, in terms of the provisions of Section 16-A of the Court Fee Act, 1870.
