% 23.01.2017 By this petition filed under Section 438 read with Section 482 of Cr. P.C., the petitioner is seeking anticipatory bail in a case registered vide FIR No.458/2014 under Section 380/448/420/34 of IPC, at Police Station Welcome, Delhi.

Perusal of the petition seeking bail reveals that the petitioner has challenged the order dated 05.12.2016, whereby the petitioner had withdrawn his second anticipatory bail application preferred before the learned Additional Session Judge-01 & Special Judge (NDPS), Shahdara.

Learned counsel for the petitioner seeks permission to withdraw the present bail application with liberty to move the court of session to avail all the grounds taken in the present petition. In view of the aforesaid stand taken by learned counsel for the petitioner, the present petition is dismissed as withdrawn with liberty as prayed for.
