% 07.02.2017 Impugned order of 4th November, 2016 grants interim compensation of `5 lacs to respondents-claimant for his treatment. The challenge to impugned order by learned counsel for petitioner is on the ground that there is no provision to grant interim compensation and that too, at the stage of final arguments. It is so submitted as it is asserted by petitioner's counsel that no adjournment was sought on behalf of petitioner to argue and now the matter is coming up before the trial court on 23rd February, 2017 for final arguments. Mr. S.N. Parashar, Advocate appears on behalf of respondentclaimant and on instructions, he submits that impugned order may be set aside with a time-bound direction to decide the claim petition. Upon hearing, I find that impugned order is not sustainable in law and hence it is set aside. Learned Tribunal shall make all endeavours to CM(M) 1293/2016
hear the final arguments on the next date as both sides submit that they are ready to finally argue the petition on the next date. In any case, the Award be rendered within four weeks of concluding the final arguments. With aforesaid directions, this petition and the application are disposed of.
