O R D E R

% 09.02.2017 By the present petition the petitioner seeks anticipatory bail in case FIR No.369/2016 under Sections 7(i)(a)(ii) of the Essential Commodities Act registered at PS Sagar Pur on the complaint of Shri Ambika Mehto, Inspector Food and Supply Department, Govt. of NCT Delhi. The allegations in the FIR against the petitioner were that when an inspection was carried out and verifications were done after door to door survey from the card-holder variation in the supply of wheat and rice weighing 2.67 quintal was found in the shop of the petitioner. Pursuant to the registration of FIR investigation has been carried out and out of the 14 card holders, 13 have been examined. 11 card holders stated that they have duly received the ration which they were entitled to. holders stated that they have not received the ration. The 3rd card holder is untraceable. Thus, though in the FIR the allegation was for discrepancy/ variation in the supply of wheat and rice for a quantity of 2.67 quintal on verification variation was found of 40 kg wheat and 27 kg rice. In view of the facts found out during investigation and the fact that the petitioner has cooperated in the investigation, this Court deems it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that he will join the investigation as and when directed and will not leave the country without the prior permission of the Court concerned.
