% 23.08.2017 The petitioner is aggrieved by the action of the respondent/Allahbad Bank. Petitioners No. 1 & 2 were the guarantors to a loan which had been advanced to respondent No.2 (principal borrower).
To cut-short the matter, it has been brought to the notice that equitable mortgage created on the property of the petitioner has since been sold in an auction; submission is that the amounts which were calculated by respondent No.1 were incorrect. An application under Section 17 of the SARFAESI Act is yet pending before the DRT-III along with another interlocutory application seeking interim directions wherein these illegalities committed by respondent No.1 (in calculating erroneous amounts due from the petitioners). Learned counsel for the petitioner points out that the next date fixed before DRT-III is 31.08.2017. The application of the petitioner pending
under Section 17 of the SARFAESI Act as also interim application filed by him be disposed of by the learned Presiding Officer DRT-III expeditiously and preferably within three months from today. Petition disposed of.
