% 26.09.2018 Learned counsel for petitioner submits that injured was discharged from the hospital long ago. Petitioner is in custody for the past 11⁄2 year. Statement of victim Suraj has been recorded. In the FIR, PW-2 Suraj had stated that co-accused Monu had caught hold of him while petitioner and Sunder stabbed him with sharp objects. However, while deposing in Court PW2 has stated that petitioner had caught hold of him from behind while co-accused Monu and Sunder stabbed him with a knife and gupti.
Learned APP submits that PW-2 was cross examined by the learned APP wherein he clarified that co-accused Monu had caught hold of him while petitioner and Sunder had assaulted him. Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand
Only) with one surety in the like amount to the satisfaction of the trial court.
Bail application is disposed of in the above terms.
