% 14.07.2015 CM No. 12062/20105 The exemption is allowed subject to all just exceptions. W.P.(C) 6614/2015 This writ petition has been filed for return of the Bid Security in respect of the auction held for Utkal-C and Mandakini Coal Mines. The petitioner was unsuccessful in both the auctions. The learned counsel for the petitioner also states that he has no claim subsisting insofar as the auctions of these mines are concerned. It is an admitted position that the petitioner had provided Bank Guarantees as bid security for each of the auctions. The details of the Bank Guarantees are as under:-

1. Bank Guarantee No. 0160IFIBG150052 for Rs 43,25,54,692/-

2. Bank Guarantee No. 0160IFIBG150055 for Rs 6,51,72,990/-

The learned counsel for the respondents have appeared on advance notice. We have heard the learned counsel for the parties. Since the petitioners have no stake remaining in the auctions conducted with regard to Utkal-C and Mandakini Coal Mines and no amount in respect of these auctions are due from the petitioner to the respondents. We direct that the said bid securities be released to the petitioner within a week. The writ petition stands allowed as above.
