By way of this application filed under Section 438 Cr.P.C. the petitioner is seeking anticipatory bail in case FIR No.351/2016, under Sections 420/406 IPC registered at PS Saket, Delhi. 2.

Status report filed by the State reads as under: "With due regard it is submitted that in continuation to the previous status report it is further submitted that, as per the directions of the Hon'ble Court, accused Sanjay Chaudhary joined the investigation of the case twice i.e. on 20/10/2017 and 2/11/2017. Further relevant documents pertaining to the ownership of the property has already been provided by the accused person and the same has been seized and taken on file. It is submitted that notice U/s 91 Cr.P.C. was served to the Tehsildar Khalalpur Distt. Raigad Maharastra, and relevant queries regarding the ownership of the land was sought for. Tehsildar Khalapur in his reply (given in Marathi) dated BAIL APPLN. 1466/2017

14/11/2017, had stated that Sanjay Chaudhary Director Wave Buildcon owns land bearing gat number 83-92 in village Kalothe Mokashi Tehsil Khalapur Distt Raigad mahrastra and the same was converted to non agricultural land in the year 2009. Further the Tehsildar has stated that no Project with the name of "Western Meadows" has ever started at this site. The photographs of the site have also been obtained and placed on file, which shows that there is a plain piece of land with one office.

Further investigation of FIR No.351/16 dated 5/5/16 U/s 406/420 IPC P.S Saket is in progress. Status report may please be accepted. The undersigned shall abide by all the directions of the Hon'ble Court."

In the above facts, in the event of his arrest, petitioner shall be released on bail on his furnishing personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of concerned IO/SHO. 4.

Petitioner is directed to join the investigation as and when required by the Investigating Officer.
