O R D E R

% 19.12.2016 Present writ petition has been filed challenging cancellation of allotment in respect of Registration No.654296/DDA14 of LIG Flat No.20, 4th Floor, Block No.E2, Sector-34, Pocket-3, Rohini, New Delhi. In the alternative, the prayer is for refund of the cost of the flat deposited by the petitioner along with interest.

Learned counsel for petitioner emphasises that petitioner has neither having a leasehold nor a freehold dwelling unit in Delhi. Issue notice.

Mr. Arun Birbal, learned counsel accepts notice for respondent. He states that respondent-DDA shall treat the present writ petition as a representation and decide the same within a period of four weeks. Learned counsel for petitioner has no objection to the same.

Consequently, respondent-DDA is directed to treat the present writ petition as a representation to Director (Housing), DDA, who is directed to decide the same within a period of four weeks after giving an opportunity of hearing to the petitioner. A reasoned order shall be communicated to the petitioner by registered A.D. post.

In the event, the petitioner is aggrieved by the said decision, petitioner shall be at liberty to file appropriate proceedings in accordance with law. With the aforesaid direction, present writ petition and application stand disposed of.
