Learned counsel for the appellant is present alongwith Smt.Shakuntala Sharma - wife of deceased appellant Sh.Vijay Sharma and placed on record a handwritten application stating therein that after the death of appellant Sh.Vijay Sharma on 19th September, 2016, she as well other legal heirs of appellant Sh.Vijay Sharma do not want to continue with this appeal.

Since the appellant Sh.Vijay Sharma has expired and his legal heirs neither file any application for their substitution in this appeal as legal heirs of deceased appellant nor as per the handwritten application placed on RSA 269/2015

record today by Smt.Shakuntala Sharma, the legal heirs of the deceased appellant are interested in continuing with the appeal, the instant appeal stands abated.
