O R D E R

% 30.08.2017 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.574/2015, under Sections 324/341/34 IPC, registered at Police Station Harsh Vihar, Delhi and all the proceedings emanating therefrom. Learned counsel for the petitioners has submitted that the petitioners and the respondent No.2 were the friends and residing in the same locality and due to a misunderstanding arisen between them, a quarrel had taken place which resulted into the registration of the aforesaid FIR against the petitioners. Counsel further submits that after the registration of the FIR, the near relatives and the friends intervened and the misunderstanding and the dispute has been amicably settle between the parties orally and nothing further remains to be adjudicated between the parties, however, the present FIR is coming as hurdle in the peaceful personal life of the petitioners and

prays that the FIR and all subsequent proceedings arising out of the same may be quashed.

The respondent No.2/complainant Deepanshu is present in Court and has been identified by the IO SI Samrat Khatiyan, P.S. Harsh Vihar, Delhi. The respondent No.2 present in person admits the factum of oral amicable settlement with the petitioners. The respondent No.2 further admits that they are residing in the same locality and he does not want further action against the petitioners and further submits that he has no objection if the present FIR is quashed.

Looking into the aforesaid facts and circumstances, since the matter has been settled amicably between the parties and the parties are residing in the same locality and nothing further remains to be adjudicated between them, to have peace in the locality and the neighbourhood and to upkeep better relations between the parties in present and in future and to meet the ends of justice, I deem it appropriate to quash the FIR and all proceedings arising out of the same.

Consequently, FIR No.574/2015, under Sections 324/341/34 IPC, registered at Police Station Harsh Vihar, Delhi and all the proceedings emanating therefrom are hereby quashed.

The present petition is allowed and disposed of accordingly. Copy of this order be given dasti to the parties. I.S.MEHTA, J AUGUST 30, 2017 'dc'
