FAO(OS) (COMM) 143/2016 & CM 46964/2016 We note that the next date fixed before the learned single Judge is 11.01.2017. It is the plea of the appellant that the price of the shares of A2Z Infra Engineering Limited is falling and they would be prejudiced if there is any delay in hearing the matter.

Consequently, we are disposing of this appeal with the direction that the application under Order XXXIX Rules 1 & 2 being IA No.14641/2016 be listed

before the learned single Judge on 06.01.2017 instead of 11.01.2017. The learned single Judge shall take up the matter for hearing on that date itself. We are making it clear that we have not expressed any opinion in this matter. The appeal stands disposed of.
