The appeal impugns a money decree in the sum of Rs.3,05,000/- against the appellant and 21 others jointly and severally. 2.

The appeal was accompanied with an application for extension of time for filing court fees.

Time of fifteen days was given to the appellant to do the needful. 4.

No court fees has been deposited.

5.

The appellant has impleaded the plaintiff/decree holder only as a respondent and has not impleaded the other defendants against whom also the decree was passed.

The appeal, without impleading all the parties to the suit, is misconceived.

7.

The counsel for the appellant states that the respondent/decree holder in execution has recovered the entire decretal amount from the other defendants/judgment debtors.

It appears that the appellant is not interested in pursuing this appeal and for this reason has not deposited the court fees. 9.

The appeal without the court fees is not property constituted and is dismissed.
