In this case, the appellant no. 1 has filed an application in the proceedings for restitution of conjugal rights which was decided in terms of the orders passed by this court. The only aspect which required examination was the material to show that the respondent had actually married the appellant no.1. The appellant no. 1 has made a grievance that instead of looking at this aspect, the learned Family Judge has gone into the criminal complaint which has been got registered by the respondent malafide, wherein the appellant has no opportunity to place her defence.
