O R D E R

% 23.10.2018 The challenge in the present appeal is to the order dated 06.09.2018 passed by the Family Court imposing cost of Rs.50,000/- (Rupees Fifty Thousand only) on the appellant herein, on account of default committed by him. Learned counsel for the appellant submits that reason for not complying with the order of the Family Court was only keeping in mind the welfare of the child.

The appellant has furnished an undertaking to this Court in MAT. APP.(F.C.) No.240/2018 and as per the undertaking, the appellant has agreed to comply with the directions of the Family Court. We have heard the learned counsel for the parties. In view of the subsequent events, the order of the Family Court is modified to the extent that the appellant would pay Rs.25,000/- to the respondent. The sum of Rs.25,000/- deposited with the Registrar General of this Court will be released in favour of the respondent.

At this stage, learned counsel for the appellant submits that the father is not being allowed to meet his child.

We have been informed by the learned counsel for the parties that application of the appellant is already listed before the Family Court for 31.10.2018.

Both the parties agree not to seek unnecessary adjournments in the matter before the Family Court.
