O R D E R

% 18.10.2016 C.M.No. 38389/2016 (u/S 151 CPC) By way of this application, respondents wish to settle the subject matter of this appeal with appellant provided they are compensated to the tune of `2,50,000/-. A similar prayer made by appellant to compensate respondents to the tune of `2,00,000/- stands already declined vide order of 29th September, 2016.

Upon notice of this application, learned counsel for appellant on instructions from Mr. Deepak Sehgal, proprietor of appellant firm , who is present in the Court, submits that appellant is ready to compensate respondents to the extent of `3,00,000/- and this amount can be released by the learned Commissioner from the pre-deposit already made by appellant.

Upon hearing and on perusal of the application and impugned order, this Court finds that the offer now made by appellant to compensate respondents to the tune of `3,00,000/- appears to be quite reasonable and is acceptable. Hence, this application is allowed and the impugned order is modified to the extent that now appellant would compensate both the respondents for a total sum of `3,00,000/- only. From the pre-deposit already made by appellant with the Commissioner, a sum of `3,00,000/- be released to both the respondents in equal share and the remaining amount be released to appellant as per rules. With aforesaid direction, this application is disposed of. Dasti.

FAO 230/2015 In terms of orders passed in C.M.No. 38389/2016, this appeal stands disposed of.
