O R D E R

% 21.12.2016 This petition has been filed by the petitioner with the following prayers:

"a) Issue an appropriate writ, order or direction to the respondents to issue degree awarded to her for Academic Years 2014-2015 instead of 2015-2016 for examination Roll No. 11058218046 as Enrollment No. RLA-226/2010 for the Course (218) (U.G.)-B.A. (Hons.) History;

b) Pass any other or further order (s) in favour of the petitioner as this Hon'ble Corut may deem necessary and fit in the facts and circumstances of the present case and in the interest of justice."

It is averred and contended by the learned counsel for the petitioner

that petitioner took admission in B.A. (Hons.) History in Ram Lal Anand College in the year 2010. She gave her 6th Semester exams in the month of May, 2014, the result of which were declared in July-August, 2014. The petitioner came to know that she has not cleared four papers, i.e., History of India-II, History of India-IV, Economics (Principle of Economics) and History of China and Japan-II. The petitioner gave the exams in the aforesaid papers as ER (Essential repeated papers) in the month of June, 2015. The petitioner had taken admission in PG-Diploma in Television and Radio Journalism / Production from Appejay Institute of Mass Communication. The result of ER was declared in the month of July, 2015, wherein she has not passed in History of India-II and History of India-IV.

In August-September, 2015 she had applied for revaluation of the aforesaid papers. The revaluation process culminated in the petitioner in passing the paper of History of India-II by getting two marks. It is averred that the two marks were decreased in the second paper i.e. History of India-IV. A representation was made by the father of the petitioner to review the papers as there is an increase of two marks and decrease of two marks in essential repeated papers. In April-May, 2016, the petitioner again appeared in the paper of History of India-IV as an external student.

the petitioner cleared all the papers of B.A. (Hons.) History. It is the submission of the learned counsel for the petitioner that since the examinations, which the petitioner took as essential repeated papers, relates back to the year 2014, the petitioner needs to be awarded Degree for the academic yar 2014-2015. Such a Submission is not appealing in view of the fact that the petitioner had appeared in one ER paper, i.e., History of India-IV as an external student and cleared the same only in the month of July-August, 2016, and the result would not have the effect of completing the graduation in 2014-15.
