% 12.07.2019 In terms of the last order, the respondents have got conducted the medical examination of the petitioner by a Board of Dental Specialists at AIIMS.
Mr. Bhardwaj has tendered in Court the communication dated 01.07.2019 along with the Report of the Medical Board, which shows that the petitioner has been found to be fit.
Accordingly, we direct the Staff Selection Commission to proceed to consider the case of the petitioner according to his merit position and the options exercised by him.
In case, the petitioner is eventually appointed, the petitioner would be accorded a seat according to his merit keeping in view the fact that this petition was preferred in 2017. He shall retain his seniority according to his merit with his batch. However, he shall not be entitled to any back wages.
The respondents are directed to complete the said process within preferably two months.
