O R D E R

% 28.07.2017 The petitioner has been transferred from 25 Battalion, which is presently stationed at New Delhi to 133 Battalion which is stationed at Silchar, Assam.

The petitioner submits that his wife had undergone surgical procedure for the treatment of PITUTAARY MACRODENOMA on 3rd May, 2017 and is currently under treatment at Delhi. It is also stated that the wife of the petitioner is undergoing IVF treatment at Delhi.

We have considered medical certificates which have been placed on record. The certificate indicate that subsequent to operation, the wife of the petitioner has been declared fit. We have also examined that the literature relating to the disease PITUTAARY MACRODENOMA.

The petitioner has been posted in Delhi since 17th May, 2014.

The petitioner had 3 years time in Delhi for his wife to undergo IVF treatment.

In view of the aforesaid position, we are not inclined to stay the movement order.

Learned counsel for the respondents on instructions states that the petitioner can comply with the movement order by 31st August, 2017. The said concession has been given so that the petitioner's wife can get in touch with the doctors who are treating her in Delhi. The writ petition is disposed of in the aforesaid terms without any order as to costs.
