CORAM:
HON'BLE MR. JUSTICE RAJIV SHAKDHER
O R D E R
% 08.05.2018 1.
Upon hearing the matter, I had asked Mr. TK Ganju, learned senior counsel, who appears for the petitioner to take instructions with regard to certain aspects arising in the case.
2.
Mr. Ganju has returned with instructions. He says that the petitioner will be satisfied, if writ petition is disposed of with observation that the expression "blacklisted/debarred/banned" which finds mentioned in para 16 of the impugned communication dated 06.06.2017 is substituted with the word "excluded" in terms of section 3(2) of the Integrity Pact. 3.
Mr. Upadhyay says that he cannot but submit that this will not materially impact the respondent corporation's stand in the writ petition. 4.
It is ordered accordingly.
5.
Mr. Ganju says that the impugned communication dated 06.06.2017 is coming in the way of the petitioner biding for other contracts with entities other than the respondent corporation.
6.
According to me, this apprehension is to say the misplaced as a careful reading of the communication dated 06.06.2017 would show its applicability is limited to contracts pertaining to the respondent corporation. 7.
The writ petition is disposed of in the aforesaid terms as prayed by Mr. Ganju.
