% 06.03.2019 The matter is reserved for judgment and was directed to be listed for directions today and thus the matter has been taken up. On a perusal of the petition, it had been stated in the brief synopsis itself that an appeal was filed against the order dated 16.03.2017 in the CGIT but as there was no Presiding Officer, the present petition had been filed vide which the petitioner has assailed the impugned order dated 16.03.2017 of the Assistant Provident Fund Commissioner in HR/RO/GGN/25340/Dmg./C-1/1877.

In reply to a specific Court query, learned counsel for the petitioner submits that though the appeal was sought to be filed, the same had not been accepted. As of date there is CGIT-II at the Dwarka Courts, which is functioning.

In the circumstances, the petitioner may seek redressal in accordance with law against the order dated 16.03.2017 of the Assistant Provident Fund Commissioner.

Learned counsel for the petitioner seeks permission to withdraw the present petition to seek redressal in accordance with law. The petition is thus dismissed as withdrawn with liberty granted as prayed to seek the redressal in terms of the enactment in accordance with law within a period of 15 days from today.

The period spent during the pendency of the present petition and the period of 15 days from today is allowed to be excluded by the learned Appellate Authority.
