% 14.02.2017 Crl. M.A. No. 2631/2017 (condonation of delay) Delay in re-filing is condoned. Application is disposed of. Crl.M.A.2630/2017 (Exemption) Allowed, subject to all just exceptions.
Application is disposed of.
W.P.(CRL) 475/2017 It is submitted that petitioner and respondent no. 2 have settled their
disputes amicably before the Delhi High Court Mediation and Conciliation Centre on 14th December, 2016 vide Settlement Agreement (Annexure P-3). It is prayed that FIR No. 333/2014 under Sections 420/34 IPC registered at Police Station Dabri be quashed. Respondent no. 2 is present in Court along with his counsel and submits that he has settled the matter with the petitioner of his own free will and without any undue force, coercion and pressure. He further submits that terms of the settlement have already been complied with and he has already received the entire settled amount. He further submits that he is not willing to pursue the FIR any further. In view of the settlement arrived at between the petitioner and respondent no. 2 before the Mediation Centre voluntarily, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 333/2014 under Sections 420/34 IPC registered at Police Station Dabri and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
