None appears for the petitioner.

The learned counsel appearing for the respondent has handed over a copy of the decision rendered by the Additional District Judge, Gurugram allowing the respondent's application under Section 34 of the Arbitration and Conciliation Act, 1996. He submits that since the arbitral award, which is sought to be enforced by way of the present petition is set aside, the present petition is not maintainable.

The said submissions are merited. The petition is, accordingly, dismissed leaving it open for the petitioner to file afresh, if the petitioner prevails in the appellate proceedings.
