% 04.10.2018 IA 13660/2018 Exemption allowed subject to all just exceptions. OMP(I)(Comm.) 389/2018 Learned counsel for the respondents, who appears on advance notice, submits that the Arbitrator has already been appointed to adjudicate the disputes that have arisen between the parties. The Arbitrator, infact, has entered reference and the first date of hearing is fixed for tomorrow that is 05.10.2018.

Faced with the above, learned senior counsel for the petitioner submits that the petitioner has serious apprehensions against the Arbitrator and he would be challenging the jurisdiction of the Arbitrator. He, however, prays for leave to withdraw the present petition with liberty to take such other action which is available to the petitioner in law.
