% 16.08.2017 Learned counsel for the petitioner has contended that false allegations have been levelled against the petitioner.
Prosecutrix was a consenting party. He submits that photographs placed on record from pages 54 to 60 clearly show that prosecutrix was a consenting party. It is further submitted that petitioner had even married the prosecutrix. Prosecutrix has registered the FIR at the behest of her family members. Petitioner is in custody for the last six months.
Charge-sheet has already been filed.
Petitioner is not required for further interrogation.
Learned APP has opposed grant of bail to the petitioner. She has contended that prosecutrix belongs to Rajasthan and was studying in
Dholpur Government Girls College.
Petitioner used to stalk her.
He forcibly developed friendship with the prosecutrix. One day, petitioner took the prosecutrix in a hotel at Dholpur and gave some intoxicating substance to her; as a consequence of which prosecutrix became unconscious, thereafter, he raped her and made a MMS. By threatening her that he would make the MMS public, he used to call the prosecutrix at different places and rape her.
To avoid the petitioner, prosecutrix came to Delhi and started living with her sister.
Petitioner followed her to Delhi.
He forcibly administered some intoxicating substance to prosecutrix and thereafter, took her to Bassi and from there to Jaisalmer and then to Jobner. He even took a room on rent and kept the prosecutrix with him. Keeping in mind the totality of facts and circumstances as detailed above, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
