BAIL APPLN. 1471/2017 This is an application filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.440/2016, under Sections 363/366/376-D/313 IPC registered at Police Station-Welcome. Learned APP for State has submitted that the custodial interrogation of the petitioner is required to identify the hospital at Badayu where the alleged miscarriage has taken place.

After some arguments, learned counsel for the petitioner submits that he be permitted to withdraw the present bail application with liberty to file fresh bail application before the concerned Trial Court.

In view of the submissions made by learned counsel for the petitioner, the present bail application is dismissed as withdrawn with liberty to file fresh bail application before the concerned Trial Court, if desires, as per law. The present bail application is disposed of accordingly. Copy of this order be given dasti.
