Transfer, in exercise of jurisdiction under Section 24 of the CPC, is sought of HMA No.698/2016 titled "Sumit Chhabra Vs. Rekha Chhabra @ Rekha Chopra" of the Court of Sh. Yashwant Kumar, Principal Judge, Family Courts, Tis Hazari Courts, Delhi to District West, Dwarka Courts, New Delhi on the ground i) that the petitioner is residing at Janak Puri and the respondent is residing at Rajouri Garden (Hari Nagar), New Delhi, both of which fall in district West; ii) that the jurisdiction of district West, Family Courts till July, 2016 was at Tis Hazari Courts, Delhi but has been shifted to Family Courts, Dwarka; iii) that the petitioner is working at the Delhi Airport and is required to fly as she is an Airhostess and Tis Hazari Courts are far away from her residence as well as the Airport; iv) that the respondent is also a Steward at the Delhi Airport and it will be convenient to both the parties if the petition is transferred to Dwarka Courts. 2.

Notice of the petition was ordered to be issued. TR.P.(C.) 171/2016

Though none appears for the respondent today but a reply is found to have been filed by the respondent in which the respondent has not disputed the aforesaid material pleas though has otherwise contested the other contents of the petition.

The petition is thus allowed.

HMA No.698/2016 titled "Sumit Chhabra Vs. Rekha Chhabra @ Rekha Chopra" of the Court of Sh. Yashwant Kumar [now presided by Dr. Sudhir Kumar Jain], Principal Judge, Family Courts, District West, Tis Hazari Courts, Delhi is transferred to the Family Court, District West, Dwarka Courts, New Delhi.

The counsel for the petitioner on enquiry states that HMA No.698/2016 is listed next on 12th January, 2018. 7.

The transferor court is requested to physically transfer the file of HMA No.698/2016, to the transferee court at the earliest. 8.

The parties to appear before the transferee court on 4th December, 2017.
