Respondent no.2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 01.08.2017 It is submitted that the respondent no.2 was tenant of petitioner no. 4 at the relevant time. Petitioner nos. 1 to 3 and 5 are relatives of petitioner no.4. Disputes arose between the respondent no. 2 and petitioner no. 4 on some trivial issues which led to the registration of present FIR No. 198/11 under Sections 426/457/380/506/34 IPC at police station Dabri, on the complaint of respondent no.2.

Respondent no. 2 has since vacated the tenanted premises.

Petitioners and respondent no. 2 have settled their disputes amicably therefore, FIR may be quashed. It is noted that mediation proceedings have been signed by the respondent no.2 and petitioner nos. 2 and 5.

Respondent no. 2 is present in Court along with her counsel and has

been identified by ASI Devender Singh of police station Dabri. She admits having settled the matter with the petitioners of her own free will and without any undue force, pressure or coercion. She further submits that she is not willing to pursue the FIR any further in view of the settlement and the same may be quashed.

Keeping in view the settlement arrived at between the petitioners and respondent no.2 and the fact that respondent no.2 is not interested in pursuing the FIR, in the interest of justice, FIR No. 198/11 under Sections 426/457/380/506/34 IPC at police station Dabri and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
