The petitioner has filed the present petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereafter the 'Act') seeking appointment of the Arbitrator to adjudicate the disputes between the parties since the Arbitrator appointed earlier, Mr P. K. Pandey, has resigned. 2.

The learned counsel for the petitioner states that after the present petition was filed the respondent has appointed Justice Dilip Raosaheb Deshmukh, (Retired) a former Judge of Chattisgarh High Court as the Sole Arbitrator and the petitioner concurs with the aforesaid appointment. He, however, requests that the arbitration be conducted under the aegis of the Delhi International Arbitration Centre (DIAC). The learned counsel for the respondent is also joins the petitioner in the aforesaid request. 3.

Accordingly, the present petition is disposed of by directing that the arbitration shall be conducted under the aegis of the DIAC and in

accordance with its Rules.

The Arbitrator shall conduct the proceedings from the same stage obtaining before previous Arbitrator.

The petition is disposed of.
