IA No.5921/2017 This is an application filed by the parties under Order XXIII Rule 3 CPC, inter alia, stating that the parties have resolved their disputes in terms of the settlement recorded in paragraph 2 of the application. The parties further pray that the suit be decreed in terms of the settlement. The said application is supported by the affidavit of the parties. In terms of the settlement, the defendants have acknowledged the petitioner as the proprietors and prior users of the trade dress in the packaging of Alpenliebe Lollipop and further agreed to change the packaging of their products.

The agreement is lawful. Accordingly, the suit is decreed in terms of the settlement. Let a decree sheet be drawn up. The application shall be form of the part of the decree sheet.
